1. Acceptance of terms
By accessing or using Eyetelli ("the Service"), provided by Squall Enterprises ("we," "our," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of service
Eyetelli is a self-hosted face recognition attendance tracking platform. The Service includes:
- Eyecore — the self-hosted server software that performs face recognition, attendance tracking, and data storage on your own hardware
- Eyepoint — camera worker software that connects your IP cameras to Eyecore for real-time face detection and event recording
- Portal — a web dashboard for managing locations, viewing attendance data, configuring settings, and accessing reports and the REST API
3. Account responsibilities
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must provide accurate and complete information when creating your account
- You must notify us immediately of any unauthorized access to your account
4. Biometric data consent
By using Eyetelli, you acknowledge that the Service involves the collection and processing of biometric data (face recognition). You are responsible for:
- Obtaining informed consent from individuals before enrolling them in the system
- Complying with all applicable laws and regulations regarding biometric data collection in your jurisdiction
- Informing enrolled individuals about how their biometric data is processed and stored
- Providing individuals with the ability to opt out of face recognition tracking
5. Acceptable use
You agree not to:
- Use the Service for surveillance, law enforcement, or any purpose other than attendance tracking
- Enroll individuals without their knowledge and consent
- Attempt to reverse-engineer the face recognition algorithms or extract model data
- Use the Service in any way that violates applicable laws or regulations
- Interfere with or disrupt the Service or its infrastructure
- Share or resell access to the Service without authorization
6. Subscription and payment
- The Service is offered on a monthly subscription basis
- Pricing is as listed on our pricing page at the time of subscription
- You may upgrade, downgrade, or cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- We reserve the right to change pricing with 30 days notice
7. Software and server requirements
- You install Eyecore on your own server. You are responsible for providing and maintaining the hardware that meets the minimum system requirements
- You are responsible for the physical and network security of the server running Eyecore
- Your server must maintain internet connectivity for software updates and license verification
- You must not reverse-engineer, decompile, or modify the Eyecore software beyond the configurations exposed through the dashboard
- You are responsible for keeping the server operating system and network environment up to date
8. Data ownership
Your data belongs to you. All attendance data, face embeddings, and enrollment photos are stored on your server under your full control. You can export your data at any time through the dashboard or API, regardless of your license status.
If you cancel your subscription, Eyecore stops processing new events after a grace period, but your existing data remains on your server. We never delete data from your hardware.
9. Service availability
We strive to maintain high availability for our licensing and Portal services but do not guarantee uninterrupted service. Eyecore continues to perform face recognition and track attendance locally during internet outages. A license grace period ensures continued operation during temporary connectivity disruptions.
We are not liable for data loss or service interruptions beyond our reasonable control, including failures of your server hardware or network infrastructure.
10. Limitation of liability
To the maximum extent permitted by law, Eyetelli and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Warranty disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that face recognition will be 100% accurate.
12. Changes to terms
We may update these Terms from time to time. We will notify you of material changes via email or through the dashboard at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
13. Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may terminate your account at any time by canceling your subscription. Upon termination, your right to use the Service ceases immediately, but your data remains on your server under your control.
